Australian Consumer Law

At Bounce Lighting, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).


You are entitled to:


  • A repair, replacement, or refund for a major failure

  • Compensation for any other reasonably foreseeable loss or damage

  • A repair or replacement if goods fail to be of acceptable quality and the failure is not a major failure

These rights exist in addition to any manufacturer warranties or service guarantees offered by Bounce Lighting or the product manufacturer.


Statutory Rights Under the Competition and Consumer Act 2010 (Cth)


When you purchase lighting products or services from Bounce Lighting, you are automatically protected by consumer guarantees under the Competition and Consumer Act 2010 (Cth).


Goods must:

  • Be of acceptable quality

  • Be fit for their intended purpose

  • Match any description, sample, or model provided


Services must:

  • Be delivered with due care and skill

  • Be fit for the purpose agreed upon

  • Be supplied within a reasonable time (if no timeframe is stated)


Business Use Consumer Rights


A business can be a consumer too. A product or service bought for business use is covered by consumer guarantees, when it meets at least one of the following criteria:


  • It costs less than $100,000 including GST

  • It is a product or service commonly bought for personal, domestic or household use

  • It is a vehicle or trailer used mainly to transport goods on public roads


However, even if one of these criteria is met, consumer guarantees do not apply when the product or service is purchased:


  • For resupply

  • For use or transformation in production or manufacturing

  • To repair or treat other goods


For example, your rights don’t apply if you purchase lighting components to incorporate into another product that you sell, or to resell them as part of your own offering.


What Is Considered a Major Failure?


A major failure occurs when a product or service:

  • Has a problem that would have stopped someone from buying it had they known beforehand

  • Is substantially different from its description, sample, or demonstration model

  • Is unfit for its normal purpose and cannot be easily repaired

  • Is unsafe


If a major failure occurs, you may:


  • Reject the product and choose a refund or replacement, or

  • Keep the product and claim compensation for the reduction in value


If the problem is minor, Bounce Lighting may offer a free repair within a reasonable timeframe.


Additional Warranties (if applicable)


You may also benefit from:

  • Manufacturer warranties

  • Extended coverage or service plans provided by Bounce Lighting

These operate in addition to your statutory rights — and do not limit your ability to make a claim under Australian Consumer Law.


Products Supplied by Third Parties


If your lighting product or service was supplied by a third-party manufacturer, your ACL protections still apply.


However, any voluntary warranties offered by third parties may need to be claimed directly from the manufacturer, not Bounce Lighting.


Dealing with the Manufacturer


If your product needs to be returned or assessed:

  • Bounce Lighting is your first point of contact, not the manufacturer

  • We will advise you of assessment timeframes

  • We may pass along your claim details to the manufacturer

  • We will share the outcome of any manufacturer evaluation with you


We reserve the right to inspect the product before offering a remedy.


When You Are Not Entitled to a Remedy


Under the ACL, you are not entitled to a refund, repair, or replacement if:


  • You changed your mind

  • You found the product cheaper elsewhere

  • You no longer want or need the item

  • The issue was caused by misuse, improper installation, or failure to follow care instructions

  • You were made aware of the fault before purchase (e.g. clearance or damaged stock)

  • You asked for custom modifications or services against professional advice

  • The issue arose from another party’s actions (e.g. a third-party installer or builder)


If Bounce Lighting offers a change-of-mind return option, this will be clearly stated in our returns policy.
